Liability insurance

The Quebec Court of appeal rules that, in liability insurance cases, an insurer can not base its obligation to indemnify solely on the basis of allegations against the insured because the obligation to indemnify is a question of fact to prove, even if, hypothetically, the insurer had not, at the stage where we first asked him, the obligation to defend the insured on the basis of these allegations.
