Disciplinary law: the principle of independence of the syndic and disciplinary immunity

The Quebec Court of Appeal recalled that the syndics and assistant syndics of professional orders can not be the subject of a disciplinary complaint for any act done in connection with the exercise of their functions. In order to ensure the control of professional acts by professional orders with the main objective of protecting the public, syndics and assistant syndics must be able to act independently to ensure the effectiveness of the disciplinary process. This institutional independence, said the Court, can not exist without the disciplinary immunity that is tied to this notion. (Landry c. Richard, 2012).
