Aboriginal law: the Métis people and non-status Indians are Indians in accordance with paragraph 91 (24) of the Constitution Act of Canada, 1867 and are within federal jurisdiction

Aboriginal law, constitutional status, Métis, non-status Indians : In a declaratory judgment rendered in January 2013, the Federal Court of Canada recognized the Métis people and non-status Indians, although not covered by the Indian Act, as having the status of "Indian" as it is referred to in paragraph 91 (24) of the Constitution Act, 1867. According to said paragraph, Indians and the lands reserved for them are within federal jurisdiction (Daniels v. Canada, 2013 CF 6).
