Insurance covering litigation

A recent judgment of the Court of Québec regarding a dispute involving insurance coverage of the ING Insurance Company of Canada, recalled that in case of any difference between the proposal and the insurance policy, we have to take into account the perspective and expectations of the insured at the time of subscription. The Court added that the proposal completed by a insurance agent may suggest that the insured will be consistent with statements made to the agent and that the agent acts as mandatary of the insurer.
