Commercial lease: the obligation to provide information on a commercial lease suretyship and the lessor's obligation to mitigate his damages - real estate law, commercial lease, suretyship

Commercial lease. The Quebec Court recently confirmed that the lessor requiring a suretyship for a commercial lease has the obligation to inform the surety to the extent of its obligations and the nature of them. The lessor having to find a new lessee after his lessee cleared out the place should not be too selective in choosing a new lessee in order to fulfill its obligation to mitigate his damages.  (Rochefort v. Ho, 2012 QCCQ 5761). Dubé Légal inc., Montreal real estate litigation lawyers.
