Real estate law, legal hypothec in favour of a person having taken part in the construction or renovation of an immovable : In a May 2013 decision, the Court of Appel recognized that in accordance with the Building Act, a legal hypothec in favour of a contractor having taken part in the construction or renovation of an immovable is only valid if the contractor in question held the appropriate permit during the period of construction. The validity of the hypothec also depends on the contractor having held the permit at the time the hypothec was registered (Schnob (Entreprises J. Schnob) v. Parent, 2013 QCCA 923).
